Contempt of court ruling against NBR chairman


The High Court has issued a ruling seeking to know why action should not be taken against the chairman of the National Board of Revenue (NBR) on charges of contempt of court. The concerned have been asked to respond to this rule within the next four weeks. Supreme Court lawyer Barrister Humayun Kabir (Pallab) confirmed this to Jago News.

On Tuesday (June 11), a bench comprising Justice JBM Hassan and Justice Raziq Al Jalil of the High Court issued the ruling.

Barrister Mohammad Humayon Kabir, co-editor of the Supreme Court Bar Association, heard the case in court. He was assisted by Advocate Bayezid Hossain, Advocate Naeem Sardar and Barrister Solaiman Tushar.

Earlier, a notice of contempt of court was sent to the NBR chairman by mail on May 19 for not complying with the judgment and order given by the High Court on November 8, 2020. A notice was sent to the NBR chairman for not submitting a progress report to the High Court by complying with the instructions of collecting tax and VAT as per the law of Bangladesh from Google, Facebook, Amazon and other internet based social media.

But for not taking any effective action, a case of contempt of court was filed against him in the relevant branch of the High Court. It is heard in its continuity.

It was said in the notice that if the instructions given by the High Court judgment are not followed within 10 days, a case will be filed against him in the High Court on charges of contempt of court. In continuation of that, the application is made.

Addressing the NBR chairman, it is said that you have received the apex court order and are well aware of the court order. You are bound to obey the court order. But still did not take into account the order of the highest court of the country. has seriously violated the court order. You will face trial for willful contempt and contempt of the highest court of the land.

In this regard, Barrister Mohammad Humayon Kabir told Jago News that on November 8, 2020, the National Board of Revenue will be required to collect every six months from all types of transactions including advertisements, domain sales, license fees, turnover tax and It is directed to file in the High Court, in the form of an affidavit, a statement of all revenue arrears including payment of supplementary duty, value added tax levied under Section 15 and income tax.

“But the Board of Revenue did not comply with the order of the High Court which amounted to contempt of court. As a result, a legal notice was sent to the chairman of NBR for contempt of court for not complying with the judgment.

Earlier on April 12, 2018, the High Court issued a ruling against the defendants and ordered all defendants including Bangladesh Bank NBR to collect taxes and VAT from all online companies including Google, Facebook, Amazon as per the laws of Bangladesh. Several online companies started paying VAT in view of the said interim order. After the final hearing of that rule, the court announced the verdict with some instructions.

It is known that on June 5 Barrister Mohammad Humayon Kabir, Barrister Mohammad Kausar along with some lawyers of the Supreme Court filed a writ in the concerned branch of the High Court on April 9, 2018 in public interest. In that writ, a total of 12 people, including the secretary of the finance ministry, the governor of Bangladesh Bank, the chairman of the National Revenue Board, Google, Facebook, and Yahoo, were made defendants.
